Plans and dealings
The majority of freehold land in the State of New South Wales is held under Torrens title and ownership of land is evidenced by a single document (folio of the Register) which records:
- the legal description of the land, based on a plan which defines the boundaries of a parcel of land
- details of ownership, and
- details of various transactions affecting the land such as mortgages, leases, covenants, easements and rights of way.
When new land parcels are created through subdivision, or when all or part of an existing parcel is to be used for a specific purpose such as an easement or lease, a plan must be prepared, lodged and registered with LPM Authority.
LPM Authority is notified of changes in the legal ownership and transactions affecting parcels of land in NSW by documents which are known as dealings. These are lodged and registered with LPM Authority under the Real Property Act 1900.
It is generally necessary to search our records and obtain copies of existing plans and dealings for inclusion in documentation to enable new land transactions to proceed.
While most Old System land has now been converted to the Torrens system, some old system parcels still remain and are registered in the General Register of Deeds. A number of non-land related transactions, such as Powers of Attorney (PDF 417 kb) are also recorded in the General Register of Deeds.
