Crown Lands Division is a key player in the maritime, industrial, residential and tourist development arena, promoting projects that help local communities grow and prosper.

As the land owner, we work with state and local government, local trust boards, and industry, in accordance with the Objects and Principles of Crown land management, which may provide some development and commercial opportunities, including sales, leasing, tenders or partnerships.

How do you lease Crown land?

The Department of Lands has developed specific business rules for commercial leasing of Crown land to reflect the government’s commitment to National Competition Policy (NCP).

This policy provides the framework for public competition ensuring commercial leasing is a fair, open, impartial and transparent process. 

NCP generally identifies that public advertising is required both legislatively and to identify the extent of any competing interests. The Crown Lands Business Directives support the competitive leasing process, and clarify the requirements for any dealing outside of a competitive process, which may be considered where substantial public benefit is to be derived from dealing on a direct basis.

Assessment of the appropriateness for a direct dealing will include:

  • A Public Interest Test (PDF 46 kb) as a threshold test
  • Essential Criteria relating to the proponent eg. the relationship between the government and the proponent, probity and integrity issues, intellectual property issues
  • Assessment of a proposals viability, plus social, economic and environmental benefits and impacts

Why sell Crown land?

Since early settlement in New South Wales, Crown land has been set aside by successive governments for public purposes and sold or leased for agriculture, grazing and settlement.

When it has been determined that a parcel of Crown land is no longer required for any government or community purpose, then the sale of that land becomes a possible option.

Land for homes, rural production, commerce and industry are developed and made available for purchase when market research has identified that there is a need for this land in a particular area. In this way, Crown land is provided where it is needed and public revenue is generated. Proceeds of the sale are used for the benefit of the people of New South Wales.

How is Crown land sold?

Crown land is not sold until statutory processes are carried out such as land assessment, native title extinguishment and aboriginal land claims are investigated.

Any sale of Crown land is performed in a professional manner through either public competition or private treaty sale at market values.

Auctions may be carried out for subdivided and developed parcels of Crown land, single remnant Crown lots, or land surplus to the requirements of other government agencies.

Private treaty sales are carried out where public competition is not considered appropriate. This is usually for remnant parcels of land or closed unused Crown roads next to the adjoining land holders.

Standard conveyancing methods are used when selling Crown land. This involves the client entering into a contract for sale in the standard real estate institute/law society format for the sale of a specified parcel of Real Property Act land.
